James Mallett of Spreyton, miller complains that by articles of agreement made 26 March 1707 between John Cole of Menheniot of Co. Cornwall Esq. and John Johnes of Lostwithell, gent. Executors in trust by the Will of Robert Burgoyne late of St.Clear co. Cornwall gent. on the one part and James Mallett on the other. Cole and Johns covenanted to lease to Mallett two thirds of two water grist mills under one roof together with the dwelling house to same belonging, then lately in the possession of Samuel Babbs, and called Tawton Mills, situated in South Tawton to hold for 99 years if James; Sibella his daughter and one other whom he shall nominate, so long should live, at a yearly rent of 9s2, and also an estate for 99 years in the other third of the mill and for this James was to pay £110 by instalments and a proper lease was to be drawn up and executed. Cole and Johns now refuse to execute and deny that any such agreement was made.
